Risperdal Gynecomastia Settlement Reached For California Plaintiff
A settlement has been reached in another bellwether Risperdal gynecomastia lawsuit, this one filed by Nicholas Sheldon who alleged he developed gynecomastia after using the atypical antipsychotic and a generic equivalent of risperidone between 1997 and 2012.
According to the lawsuit, Sheldon was diagnosed with the male breast growth in July 2010. He indicates in his complaint that at that time, neither he nor his doctors were aware of the association between Risperdal and gynecomastia.
Like hundreds of similar Risperdal gynecomastia suits, Sheldon’s complaint alleges Johnson & Johnson (J&J) and its subsidiary, Ortho-McNewil Janssen Pharmaceuticals, knew or should have known about the gynecomastia risk from Risperdal. Instead of taking appropriate action, the defendants hid their knowledge of the adverse effect not only from the public but also from the medical community.
In his complaint, Sheldon states “The current warnings for [Risperdal] are still simply inadequate. The Pharmaceutical Defendants have failed and continue to fail in their duties to warn and protect the consuming public, including the Plaintiff herein.”
Sheldon filed his lawsuit just days after a bellwether Risperdal case was set to go to state court. However, J&J reportedly reached a settlement in that Risperdal case on January 6, avoiding the uncertainty of a jury trial.
J&J settled another bellwether Risperdal lawsuit claim in November 2016. The details of both agreements are confidential and have not been disclosed.
Verdicts reached in other bellwether cases include $70 million in damages to the family of five year old boy in Tennessee in 2016, another for $500,000 in December 2015, $1.75 million in November 2015 and $2.5 million in February 2015.
There remain a large number of Risperdal complaints against J&J, which the company has been unable to resolve, so additional bellwether trials are expected.
