Taxotere Lawsuit Funding

Taxotere is a chemotherapy drug used to treat breast cancer and certain other cancers, including prostate cancer, non-small cell lung cancer, advanced stomach cancer and head and neck cancer. According to U.S. Breast Cancer statistics, approximately 1 in 8 women in America will develop invasive breast cancer over the course of their life. Of the three million women in the U.S. currently living with breast cancer, an estimated 75 percent of them were prescribed Taxotere (generic name docetaxel).

Since the FDA approval of Taxotere in 1996, thousands of Taxotere lawsuits accuse Sanofi-Aventis, the manufacturer, of failing to warn cancer patients of permanent hair loss.  Although many chemotherapy agents can cause temporary alopecia (hair loss), the drug company didn’t warn U.S. patients of permanent alopecia as a possible side effect until an FDA update in 2015, allegedly ten years after it warned doctors and patients in Europe. (Canadian patients were warned in 2012.) Before 2015, the U.S. Taxotere label stated that “hair generally grows back after completing treatment”. Sanofi-Aventis in the 1990s even reported that up to nine percent of Taxotere patients suffered permanent hair loss.

Several studies have also linked Taxotere to permanent hair loss. A study conducted in 2006 at the Rocky Mountain Cancer Centers in Colorado found that 6.3 percent of breast cancer patients grew back less than 50 percent of their hair after they were given Taxotere in combination with other chemotherapy drugs. In 2013 the National Cancer Research Institute study found that 10-15 percent of patients who took Taxotere suffered from permanent hair loss.

Women who undergo chemotherapy expect their hair to fall out, but they also expect it to return. Hair loss is associated with depression, anxiety, lower self-esteem, decreased self-confidence, and other emotional issues. Female Taxotere patients who have recovered from cancer report that they have not made a full recovery due to baldness.

To make matters worse, Taxotere Alopecia patients may have chosen alternative chemotherapy drugs that do not cause permanent hair loss if they had been warned about the risk. (One study showed that 89 percent of women given Taxol, generic name paclitaxel, had higher survival rates over those that were treated with Taxotere.)

 

Taxotere Lawsuits

The first Alopecia Taxotere  lawsuits were filed in mid-2016 and lawyers in all 50 states are still filing new lawsuits. As of February 2018, over 7,500 Alopecia federal Taxotere lawsuits are pending in a Multi-District Litigation (MDL No. 2740) in the U.S. District Court for the Eastern District of Louisiana. The first bellwether trial is scheduled for September 2018, and at least four more cases are expected to go to trial in 2019. (Bellwether trials are designed to help gauge how juries may respond to certain evidence and testimony that may be repeated throughout the litigation.)

All Taxotere lawsuits claim that Sanofi-Aventis knew or should have known about the risk of permanent hair loss but failed to provide adequate warnings. Instead, the drug company provided false and misleading information that suggested hair regrows following Taxotere treatment. Permanent alopecia has not been associated with other, equally effective breast cancer treatment options. In their lawsuits, plaintiffs say that if they had been warned about this risk, they would have chosen alternative breast cancer treatments, such as Taxol, that are not associated with permanent alopecia.
